Risks
Users of the Portal are advised that there are risks associated with the use of online facilities through the Portal. Users should also be aware of and acknowledge the risks involved when performing any transactions or enquiries online. The User’s use of the Portal shall be deemed as acceptance of such risks.
Whilst HLAM is committed to maintaining a high level of security for the Portal, there are risks beyond HLAM’s control in internet communications and Users agree to assume such risks. As a precaution, Users should always ensure that their personal computer and/or other device(s) used to access the Portal is secured and protected from unauthorised access, malware or viruses that may reveal any information, including but not limited to confidential information to third parties. Users should also be wary of email scams and attachments that may attempt to obtain or steal information about and/or from them.
Please note that any communication via the Portal is not transmitted via a private or secure link or in an encrypted form and is therefore subject to the usual hazards of internet communications. HLAM cannot guarantee that communications will not be wrongfully intercepted or modified by any party.
The User understands, acknowledges and accepts that there are risks associated with online transmissions and internet access. Some of the risks are set out below (non-exhaustive):
- internet transmission lines are not encrypted and that electronic mail is not a secure means of transmission
- the transmission of information via electronic mail involves the risk of errors, viruses, delay, interception, modification or amendment by unauthorized persons
- transmission of electronic mail may be disrupted, interrupted, delayed or incorrect
The User is advised to study all the aforesaid risks carefully before deciding to apply for the Portal. The User is also reminded that:-
- the use and storage of any of the User's information, including but not limited to, the User's email address, username and password, account information, account balances, transaction activity and/or any other information available on the User's computer terminal, mobile or any other type of device which is available for connection to the internet and used by the User to access/view the Portal shall be at the sole risk and responsibility of the User and shall be solely for the User’s own purposes and the Portal shall not be extended for use by third parties; and
- it is the responsibility of the User to notify HLAM immediately of any change to the User’s mailing address, email or other particulars of the User relevant to the T&C.
The User’s access and continued access to the Portal shall be subject to the User’s agreement and continued compliance with the terms and conditions herein. The User shall utilise the Portal in strict compliance with any security or other requirements imposed by HLAM in its absolute discretion. HLAM may at any time impose conditions or requirements to improve the integrity and security of the Portal and the User shall comply strictly with all such conditions and requirements.
The User shall notify HLAM in writing immediately and in any event no later than two (2) Business Days from the time the User becomes aware, of any:
- loss or theft of the User’s User ID, passwords, and/or account numbers or other personal or security information relating to the User’s Account or the Portal
- unauthorized use or interception of any of the User’s ID, passwords and/or account numbers or other personal or security information relating to the User’s Account or Portal or any information (data, facts, opinions and any other information provided through or in relation to the Portal)
- receipt of confirmation of a transaction which the User did not place, or any similarly inaccurate or conflicting report, account statement or information; or
- unauthorised disclosure, access or use of the Portal or the User’s email address
The User agrees that the User is solely responsible for the User’s computer, system or other device from which the User accesses the Portal, including without limitation the maintenance, operation and permitted use of such computer, system or other device. The User shall ensure that any computer, system or other device from which the User accesses and uses the Portal is properly maintained and free from any defects, viruses or errors. It shall be the User’s responsibility to ensure that the User’s computer, system or other device is loaded with the latest anti-virus and anti-spyware software and that the said software is at all times installed and updated.
HLAM shall use reasonable endeavours to provide accessibility to the Portal and shall not be held liable for any maintenance issues and/or unavoidable downtime or disruption. Notwithstanding anything contained herein to the contrary, HLAM shall not be held liable or responsible for:
- any system maintenance, disruption, unavailability of the Portal, computer, telecommunications, electrical or network failure and/or other causes beyond HLAM control that may result in the Portal being incomplete, unavailable for access/viewing or delayed in transmission through any applicable internet service provider, communication network service provider, network system or such other equivalent system in any jurisdiction via the Portal
- any loss of transmission of part of or the whole of any communication between the User and HLAM through electronic mail and any interruption of the Portal
- any errors, viruses, delay, inaccuracy, losses, damages, costs, charges and/or expenses whatsoever that may be suffered or incurred by the User arising from or in connection with, whether directly or indirectly, the User's use of the Portal, including but not limited to any unauthorized or illegal interception, modification or amendment by unauthorized persons, disruption, interruption, delay or inaccuracy of electronic mail or non-delivery, technical failure or problems in transmission due to or arising out of using the internet and electronic mail as a means of transmission or other communication equipment or facilities. For the avoidance of doubt, HLAM shall not be liable or responsible for any losses suffered whether direct, indirect, consequential or special damages that may result from the use or inability to use the Portal, even if HLAM may have been specifically advised of the same; and
- any failure or omission by the User to ensure accuracy, authenticity, completeness or timeliness of any information received via the Portal
Note: Capitalised terms used herein shall have the meanings ascribed to them in the Terms and Conditions for the Use of the Portal.
